Welcome to Moments. By using this application, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the application.

1. Description of Service

Moments is a subscription-based note-taking application designed to help users capture and organize their life. Services include, but are not limited to, rich text editing, media attachments, and iCloud backup.

2. In-App Purchases and Subscriptions

Moments offers premium features via a subscription model.

  • Subscription Cycles: Subscriptions are billed on a monthly or annual basis as selected by the user.
  • Automatic Renewal: Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Payment: Payment will be charged to your iTunes Account at confirmation of purchase.
  • Management: Users can manage or cancel subscriptions in their App Store Account Settings after purchase.
  • Refunds: All billing and refunds are handled directly by Apple. We do not have the authority to issue refunds for App Store transactions.

3. User Content and Ownership

  • Ownership: You retain full ownership of the notes, data, and media you create. We do not claim any intellectual property rights over your content.
  • iCloud Synchronization & Backup:
    • The App utilizes Apple’s iCloud (CloudKit) for data synchronization and backup. By enabling these features, you acknowledge that your data will be stored on servers managed by Apple.
    • User Responsibility: You are responsible for maintaining sufficient iCloud storage space and ensuring your device is properly connected to the internet.
    • Data Integrity: While we provide the tools to sync data, you are solely responsible for verifying that your backups are successful. We are not liable for data loss resulting from your failure to manage your iCloud account or storage.

4. Privacy and Data

Your use of the App is also governed by our Privacy Policy. Please review it to understand how we handle your data, including our commitment to not accessing your private notes.

5. Prohibited Conduct

You agree not to:

  • Reverse engineer or attempt to extract the source code of the App.
  • Use the App for any illegal activities or to store content that violates the rights of others.
  • Interfere with the security-related features of the App.

6. Disclaimers and Limitation of Liability

  • "As Is" Basis: The App is provided "as is" and "as available." We do not guarantee that the App will be error-free or uninterrupted.
  • Inherent Nature of Software: We are not liable for errors, delays, or data loss arising from the inherent nature of the software, system updates, or third-party service failures (e.g., iCloud, RevenueCat).
  • Maximum Liability: To the maximum extent permitted by law, our liability shall not exceed the total amount paid by you for the App in the 12 months preceding the claim.

7. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the App after changes constitutes acceptance of the new terms.
